1. CONTENT OF THE TOURIST PACKAGE SALE CONTRACT

The tourist package offered by Great Sicily DMC is described in the official catalog, on our website, or in a personalized travel program sent to the Traveler. The contract also includes the booking confirmation and any documents required by Art. 36, paragraph 8 of the Italian Tourism Code.
When the booking is made through a Travel Agency acting as an intermediary, the booking confirmation is issued by the Organizer and sent to the Agency, which in turn provides it to the Traveler. By confirming the booking, the Traveler accepts these General Terms and Conditions, both for themselves and on behalf of all participants included in the booking.

2. LEGAL SOURCES

The sale of tourist packages is regulated by Italian Legislative Decree No. 79 of May 23, 2011 (“Tourism Code”), as amended by Legislative Decree No. 62/2018 implementing EU Directive 2015/2302. The provisions of the Italian Civil Code and Navigation Code (Royal Decree No. 327 of 30.03.1942) also apply.

3. ADMINISTRATIVE REQUIREMENTS

The Organizer and the Selling Agency are both legally authorized under Italian law and operate with valid professional liability insurance and participation in a guarantee fund to protect Travelers in case of insolvency or bankruptcy. This ensures the Traveler’s right to reimbursement of amounts paid and repatriation if necessary.

4. DEFINITIONS

  • Traveler: any person who purchases or intends to purchase a tourist package.

  • Organizer: Great Sicily DMC, the company responsible for putting together the package and providing it as a single product.

  • Intermediary/Seller: a Travel Agency that sells the Organizer’s packages.

  • Tourist Package: the combination of at least two travel services (transport, accommodation, excursions, etc.) for the same trip.

  • Force Majeure / Extraordinary Circumstances: events beyond the control of either party (natural disasters, pandemics, wars, strikes, government restrictions) that make the contract impossible to perform.

  • No-Show: failure of the Traveler to present themselves at the agreed meeting point, departure point, or accommodation check-in without prior notice.

5. PRE-CONTRACTUAL INFORMATION

Before signing the contract, the Organizer provides the Traveler with all mandatory pre-contractual information, including:

  • Destination(s), itinerary, and type of accommodation.

  • Transportation details (flight/train schedules if included).

  • Total price of the package, including taxes and service charges.

  • Payment methods and deadlines.

  • Minimum number of participants required (if applicable).

  • Passport, visa, and health requirements for the destination.

  • Cancellation policies and applicable penalties.

  • Insurance options available.

6. CONTRACT CONCLUSION AND PAYMENT TERMS

6.1 The contract is concluded when the Organizer sends written confirmation of the booking.
6.2 The Traveler must report any special requests (e.g., dietary needs, mobility restrictions) at the time of booking. The Organizer will do its best to satisfy such requests but cannot guarantee them unless explicitly confirmed in writing.
6.3 Payment Schedule for Groups:

  • 25% deposit at confirmation

  • 25% second payment 45 days before arrival

  • 50% balance 30 days before arrival
    6.4 Individual travelers may be required to pay different conditions (e.g., full payment at booking for online reservations or promotional fares).

7. LATE PAYMENTS AND PENALTIES

If payments are not made within the agreed deadlines, the Organizer may cancel the booking without refund and apply late payment interest as allowed by law. Recovery of outstanding amounts through legal channels is expressly reserved.

8. PRICE CHANGES

8.1 The price may be increased up to 8% due to changes in fuel costs, airport/port taxes, or exchange rates.
8.2 Price reductions for cost decreases will also apply.
8.3 No price change will apply within 20 days of departure.
8.4 If the increase exceeds 8%, the Traveler may withdraw from the contract without penalties.

9. DISPUTE RESOLUTION AND JURISDICTION

In case of disputes, the parties will first attempt mediation. If unresolved, jurisdiction lies with the court of the Organizer’s registered office, unless otherwise required by mandatory law.

10. CANCELLATION POLICIES

  • More than 60 days before arrival: Full refund of all amounts paid, except for documented non-refundable costs (e.g., issued airline tickets, prepaid hotel rooms).

  • 60–45 days before arrival: 50% of total price charged.

  • 45–30 days before arrival: 75% of total price charged.

  • Less than 30 days before arrival: 100% of total price charged.
    In case of Force Majeure, cancellation is penalty-free, but non-refundable expenses already incurred may be deducted with proof provided.

11. TRANSFER OF PACKAGE

The Traveler may transfer the package to another person by giving written notice at least 7 days before departure. Both parties remain jointly responsible for any additional costs resulting from the transfer.

12. TRAVELER RESPONSIBILITIES

Travelers are responsible for ensuring valid travel documents, respecting local laws and customs, and for any damages caused to accommodation, transport, or third parties. Costs will be charged directly to the Traveler.

13. DATA PROTECTION

Personal data are collected and processed in compliance with GDPR (EU Regulation 2016/679) for the sole purpose of managing bookings and providing services.

14. ORGANIZER LIABILITY

The Organizer is responsible for the proper execution of the package. Liability is excluded when failure is due to:

  • the Traveler’s actions;

  • unforeseeable third-party actions;

  • Force Majeure events.
    Assistance will be provided in case of difficulty (healthcare, consular support, alternative transport), within the limits of local laws and operational feasibility.

15. INSURANCE

The Organizer requires all Travelers to have travel insurance covering at least:

  • Trip cancellation

  • Medical expenses up to €50,000

  • Lost or delayed luggage
    Travelers must provide proof of coverage before departure. Additional insurance for special activities may be required.

16. EMERGENCY EVENTS

In case of global emergencies (pandemics, wars, natural disasters), the Organizer may change itineraries, postpone services, or cancel the package. In such cases, the Organizer will offer:

  • alternative arrangements of equal or higher value,

  • or travel credits/vouchers valid for future dates,

  • or refunds in accordance with applicable law.

17. SALE OF INDIVIDUAL TOURIST SERVICES

When individual services are sold (e.g., day tours, transfers, tickets), the Organizer acts only as an intermediary between the Traveler and the actual provider. In such cases, liability for the correct performance lies with the service provider.

18. ONLINE BOOKINGS AND PAYMENTS

For services booked and paid directly online through the Great Sicily website:

  • The booking is confirmed only after the Traveler receives an automatic email confirmation.

  • The Organizer is not responsible for errors in data entry by the Traveler or for emails not received due to spam filters or incorrect addresses.

  • Online payments are managed securely through certified providers; the Organizer is not responsible for issues arising from the Traveler’s bank or credit card.

19. ADDITIONAL INFORMATION

  • Some activities require minimum participant numbers. If these are not met, the Organizer may cancel the activity with a full refund.

  • Some services (museums, attractions, restaurants) may be closed due to holidays, strikes, or maintenance. The Organizer will always try to provide alternatives of equal value.

  • Any allergies, medical conditions, or dietary requirements must be communicated at booking. Failure to disclose such information releases the Organizer from related liability.
